1. Acceptance

By accessing hoofsignal.com, you (“User,” “you”) agree to these Terms and to our Privacy Policy. If you disagree, do not use the Service.

2. Eligibility

You must be 18 years or older and legally allowed to view gambling-related content in your jurisdiction.

3. The Service

HoofSignal provides informational horse-racing analytics and probabilistic “signals.” We are not a sportsbook, broker, or investment adviser. No content constitutes betting advice or a guarantee of profit. You bear all risk for any wagers or financial decisions.

4. Account Rules

  • Keep credentials confidential.
  • One account per person.
  • You’re responsible for all activity under your login.
  • We may suspend or terminate accounts for breach, abuse, or chargebacks.

5. Intellectual Property

All site code, models, and content are © 2025 Cashman Picks LLC unless noted. You receive a revocable, non-transferable, non-exclusive license to view and use the signals for personal, non-commercial use. You may not scrape, resell, redistribute, or reverse-engineer our models without written consent.

6. Plans, Pricing & Refunds

  • Subscription details are shown at checkout.
  • We bill upfront; renewals are automatic until cancelled.
  • You can cancel anytime → service continues to period end, no prorated refunds.

7. Disclaimers

AS IS / AS AVAILABLE. We disclaim all warranties (express or implied) including merchantability, fitness for a particular purpose, and non-infringement. Data may be delayed, inaccurate, or unavailable.

No Betting Liability. Any wagers or bets you place based on HoofSignal’s analytics, signals, or other AI-generated content are made solely at your own risk. Cashman Picks LLC is not responsible for any betting losses or other financial consequences arising from your use of the Service.

8. Limitation of Liability

To the maximum extent permitted by law, Cashman Picks LLC’s total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid us in the previous 12 months. We are not liable for indirect, incidental, consequential, or punitive damages (lost bets, lost profits, etc.).

9. Indemnification

You agree to defend and hold harmless Cashman Picks LLC, its founders, and employees from any claim or demand arising out of your use of the Service or violation of these Terms.

10. Prohibited Conduct

  • Automated scraping or brute-force queries
  • Sharing subscriber-only content publicly
  • Using the Service to facilitate money laundering or illegal gambling
  • Uploading viruses or interfering with network stability

11. Third-Party Links

Links to odds feeds, affiliate sportsbooks, or Discord communities are provided “as is.” We don’t control external sites—visit at your own risk.

12. Governing Law & Venue

These Terms are governed by Oklahoma law, U.S.A., without regard to conflict-of-law principles. Any dispute will be litigated exclusively in state or federal courts located in Tulsa County, Oklahoma.

13. Binding Arbitration

BY USING THE SERVICE, YOU AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL BE RESOLVED EXCLUSIVELY BY FINAL AND BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") UNDER ITS CONSUMER ARBITRATION RULES. YOU WAIVE YOUR RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. EACH PARTY BEARS ITS OWN FEES AND COSTS UNLESS THE ARBITRATOR DETERMINES OTHERWISE.

14. Changes to Terms

We may modify these Terms at any time. Material changes → 14-day advance notice via e-mail + banner. Continued use after the effective date constitutes acceptance.
